The visa is one of the most crucial document that ensures your entry into the USA. Without a visa you wouldn't be allowed to enter the USA boarder. Some international travellers can enter the USA without a visa, if that country meets the criterion for visa-free travel. However, when you are travelling from India, getting a visa is a must to visit the USA.

While many think getting a US visa is a difficult task, having a clear understanding of the process to acquire it will surely make things simpler and smoother.

What is USA Visa?

A US visa is a travel authorisation document that is attached or printed to the passport and gives residents of other nations permission to visit the United States of America for a specific reason, such as business tours, vacations, medical treatments, or educational programs.

  • B-1/B-2: These visas are for temporary visitors who wish to travel to the US. B-1 is issued to those who want to consult with business associates, attend conferences, negotiate a contract, etc. B-2 visa is issued for tourism purposes (vacation or medical treatment). Such visas allow individuals to visit the US for a limited duration.
  • F/M: This visa is for international students who wish to pursue academic studies at an accredited US educational institution. The course of study and the type of school the student plans to attend determine whether he/she needs an F visa or an M visa.
  • J: You must have heard of exchange programs. This is for individuals participating in approved exchange programs, including students, scholars, teachers, and cultural exchange participants.
  • H-1B: This visa is for skilled workers in speciality occupations that require specialised knowledge. It allows US employers to hire foreign professionals in fields such as engineering, IT, and medicine.
  • L: Dreaming of an intracompany transfer? This visa allows MNCs to transfer employees from foreign offices to US branches or subsidiaries.
  • O: This visa is issued to people with extraordinary abilities in the sciences, arts, education, business, athletics, or the motion picture and television industry.
  • D, A & I: There’s D Visa for crew members, A for foreign government officials, I for journalists.

 

How to Get a Non-immigrant Visa

Here are the steps to apply for a non-immigrant visa:

  • Choose the type of visa and category depending on your purpose of travel.
  • Complete the Non-immigrant Visa Application Form DS-160 online, which can be found on the website of the US consulate. Make sure you enter the correct information because you can’t make any changes after the DS-160 form is submitted.
  • Pay the US visa application fees. The fee depends on the type of visa that one has applied for.
  • After submitting the form, you have to schedule two visa appointments - one for the VAC or the Visa Application Center and one for the visa interview at the Embassy/Consulate. You will receive an interview confirmation letter which must be taken on the day of the interview. The interview is mandatory for all non-immigrant visa applicants aged between 14 and 79 years.
  • Attend the interview with supporting documents, such as a valid passport, appointment confirmation page, DS-160 confirmation page, etc.
  • When your visa application gets approved, you will receive an email and SMS that your Passport is Ready for Pickup. You can collect it from the pickup location selected by you. The processing time depends on the visa type and can range from a few days to a few months.

 

2. Immigrant Visa:

An Immigrant Visa is issued to people who want to relocate to the US permanently. It can take 2 weeks to 4 months to obtain an Immigrant Visa. With this visa, you can work and live in the US as long as you want.

Here are some of the most popular visa types under the Immigrant Visa:

  • IR: These visas are for an Immediate Relative, i.e., an individual who is the spouse of a US citizen. Close family members of US citizens or lawful permanent residents also have to apply for this, given a citizen sponsors them.
  • E: These visas are for individuals seeking to become lawful permanent residents (i.e., Green Card Holders) through employment-based channels. They include various preference categories (E-1, E-2, E-3, etc.) based on factors such as skill and education.
  • DV: The Diversity Visa provides a limited number of immigrant visas to individuals from countries with low rates of immigration to the US. It is allotted through an annual lottery system.

How to Get Immigrant Visa

Steps to apply for an Immigrant Visa

  • The first step is to get PCC or the Police Clearance Certificate that the Regional Passport Office issues. You cannot enter the US Embassy for the scheduled interview without this. The PCC has validity, so check before you schedule the appointment.
  • Complete the required medical examination by an approved medical practitioner.
  • Complete the DS-260 Form online with your Invoice ID number and Beneficiary ID number. The Immigrant Visa Application Processing Fee Bill Invoice will have the invoice ID and Beneficiary ID. Check all the details before submitting, as you cannot make any changes after submitting the form.
  • Schedule your visa appointment interview — one for the Visa Application Center (VAC) and one for the visa interview at the Embassy or Consulate.
  • Attend the interviews at both places with all the required documents, such as a valid passport, appointment confirmation page, DS-260 confirmation page, police clearance certificate, medical examination report, etc.
  • Once your visa application gets approved, you will be notified to collect the passport from the pickup location you opted for.

These are just a few examples of popular visa types within each category. The purpose of your travel and other relevant facts determine what type of visa is required under the US immigration law, and a lot depends on the eligibility criteria and application processes.

Validity for Different Types of US Visa

Non-immigrant visas are granted for brief stays of up to six months, beginning from a few days. The approved visa does not, however, confirm the time frame. When you arrive in the nation, the validity of your visa is approved. The US Customs and Border Protection Officers will decide whether to approve it depending on the reason for your stay and the anticipated time frame for completing it. The visa's stated expiration date does not specify the length of time it will be valid. It just states the time by which you can enter the US.

On the other hand, the validity of an immigration visa is 6 months from the date it has been issued. This means you need to visit the USA within those 6 months else you won’t be allowed to enter. Also, it is restricted to only one entry. The immigrant visa functions like a ticket for entry into the United States. You are only eligible to become a permanent resident only when you fulfil all the government-laid conditions.

Considering appointments are regularly booked two to three months ahead, it is strongly advised for applicants to begin the application procedure at least three months before the anticipated date of the trip. You will find many forms that are in the I series, including I-130, I-159, etc. After you've downloaded the correct application form for your visa, you need to correctly fill it out and upload it or you can go to the embassy office directly. You will then be invited for an in-person interview after all the pertinent forms needed to complete the US visa application process.

How to Check US Visa Status Online?

To check the progress of your visa application online, follow the steps mentioned below:

  • Log in to the US CEAC's (US Consular Electronic Application Center) official site
  • Click on "Check the status of my visa application"
  • Choose the type of visa application you have applied for
  • Select the location you had selected for the interview while filling out the application form
  • Type in your application, then click "Submit".

You can see whether your visa application to the US has been approved, rejected, or is still being processed administratively.

On average, it takes 21 working days to complete a visa after the Embassy receives your application. Following your interview and meeting, you will discover if you were granted a visa to the US or not in case no further verification or additional administrative review is needed.
