The temporary injunction comes into effect when the suit is still pending. Whereas a permanent injunction applies on the final disposal of the suit.

The chances of you winning the suit largely depends on the documents that you provide, which prove your right on the land in question. If you have adequate documents and supporting documents, the suit becomes a bit easier. Given the legal complications involved, it is highly recommended to opt for a home insurance policy.

Sections of Indian Penal Code Used Commonly For Land Grab:

Here are some of the most used Indian Penal Codes for land-grabbing cases.

1. Section 441:

This section of criminal trespass is effective when a person lawfully enters a property but does not evacuate on completion or term or unlawfully enters a property with the intent of insulting, intimidating or annoying the property holder.

2. Section 425:

This section applies when an individual(s) intentionally causes damage to the property in question, which can lead to a diminishing in the value of the property.

3. Section 420:

This section applies when an individual deceives and cheats on you to deliver the property in question to someone else.

4. Section 422:

This section applies when an individual unlawfully enters a building that is used to keep custody of the property or is used for worship.

5. Section 503:

This section applies when an individual threatens damage to property or injury to a person with the intention of forcing them to do something that they should not legally do.

How To Prevent Land Grabbing?

There are a few simple measures that you can carry out from your end to ensure minimal risk to land grabs. Here is what you must do:

1. Always ensure that your property documents are in order.

2. Do not forget to pay all the utility bills and necessary government taxes on time and keep receipts of the same.

3. You must adhere to some of the state laws, which include registering your property with the local authorities.

4. If you are not staying at the property, ensure that someone inspects the property at regular intervals.

5. Always secure your property with homeowners insurance. By paying a small premium, you can safeguard your property even in your absence.
